الملخص: | Consumers justly demand fair treatment and high standards in the whole range of services including in the motor vehicle repair and service industry. Nevertheless, consumer services seem to be neglected compared to the attention paid to consumer sales, consumer credit and supply of goods. The rights of consumers to seek for redress mainly lie under the law of contract, the law of tort and the Consumer Protection Act 1999. This research seeks to come out with a comprehensive consumer protection in the service industry with special reference to the motor vehicle repair and service. In doing so, the study focuses on the civil liabilities of service providers and the rights of consumers for redress. As such, this research analyses the extent to which the laws of Malaysia provides adequate protection to consumers. The discussion includes the analysis on the contract law, the tort law as well as the CPA. A small survey also has been carried out to get the consumers' viewpoints and feedbacks on the matters. This study proves that there are many hindrances under the contract law and the tort law for the consumers to seek for remedies. In addition, there exist lacunae and ambiguity in the statutory provisions under the CPA which need further amendments. Though, the Tribunal for Consumer Claims is able to provide for a good alternative redress mechanism to consumers which are cheap, quick and relatively informal manner, there are several drawbacks in the operation of the TCC that need further improvements in order to maximize it as the best redress mechanism for consumers. By the end of the research, the researcher outlines several proposals for amendments in the interest of all Malaysian consumers so that they will get optimum protection especially in the motor vehicle repair and service industry. Hopefully, this research can benefit many people such as the academicians, consumers, legislators, law enforcers and service providers. |
