| Summary: | This thesis treats the ahadith concerning the legislative features of distinction from the non- Muslims (mashru'iyyat mukhtalafat ghair al-muslimin) and its principles, keeping the contemporary reality in view. The researcher has applied the inductive method for classifying the ahadith concerned from various sources of hadith literature. The researcher has also applied the critical method for explaining the status of ahadith as being accepted or rejected. Most of those ahadith as identified by the researcher are acceptable according to the hadith criticism rules. A few of them are weak (da'if) and fabricated (mawdu'). The researcher has also applied the analytical method in analyzing ahadith al- mukhtalafat and concluded that there are two kinds of almukhtlafat: obligatory (wujub) and none obligatory i.e recommendation (nadb and istitihbab) and preference (tafdil). The study has looked into two important aspects in dealing with those ahadith: the methodological aspect in recognizing and understanding the characteristic of the ahadith and the scientific aspect in applying those ahadith in modern reality. Finally, the researcher reached the conclusion that the discussion of ahadith al- mukhtalafat is in need of further discussion from the angle of the Islamic juridical criticism because of its importance to the Muslims. At the end of the research, the researcher unfolds her findings of the study and gives its references. |
