Description
Summary:The study aims at gathering the Qur'anic verses dealing with financial contracts in order to examine and prepare a concrete platform through which the validity and/or otherwise of these contracts will be revealed by citing the contributions of the classical and contemporary commentators of the Holy Qur'an, thereby creating a chance for such a platform to be implemented in the abovementioned contracts. The research will solemnly depend on the authentic Prophetic tradition, contributions of the commentators of the Holy Qur'an, researchers, religious and jurisprudential entities by supporting or criticizing them objectively based on the research principles and ethic. It is in the light of this, the research work has identified six fundamentals from Qur'an that are necessary for the contract and investment to be valid and justifiable. These include: the basis and essence of every financial contract should be legal; consensus between trading partners; the object of the contract should be lawful (Halal); abolition of any form of injustice between the trading partners; prohibiton of riba; prohibition of consuming people’s wealth unjustifiably; like gambling and gharar. The researcher has dedicatedly carried out a research on the importance and significance of acquiring wealth in the Holy Qur'an, and found out that Qur'an has encouraged people to acquire wealth through lawful means that are not contrary to the abovementioned fundamentals. Moreover, the research presented some refutations to some statistical figures on those verses together with other versions of the commentary. The research concluded that conducting financial contracts and activities under the umbrella of Qur'an will be the lasting solution to our contemporary financial problems, with the condition of having those activities and contracts handled by capable, dedicated and outstanding people with vast experience in this field and its branches, fully knowledgeable in the philosophical aspects of finance.
