Summary: | This study is an attempt to examine the legal signification of conjunction
(Dilalat al-Iqtiran) as it is understood by usuli scholars. The study tries to define and
determine its position with other basic usuli scholars as well as logical concepts that
are used in the field. Besides, the study discusses the authority of this signification,
while it gives more attention to the conditions that allow proper application of such
conjunctions to the legal texts. The study also addresses the textual forms of this
signification, its semantic function and the legal rules derived from there. The
researcher deals with the subject by using inductive, analytical and critical methods.
Through the first, he conducts a survey of the relevant materials produced on the topic.
By the two other methods, the researcher attempts to re-examine what has been held
on the issue at hand by expanding what has been summarized and clarifying what has
been ignored or addressed only in brief. The study concludes that the presence of such
conjunction in the texts has a significant role in orienting the semantics of the legal
evidence and constructing its purport by the jurists (fuqaha'), exigists of the Qur`ān
(Mufassiran), and usuli scholars. Such significance is variable in strength and
weakness according to the position it may hold. The study aims to identify some
specific semantic roles that the conjunction may play, and which have an impact on
the understanding of the arguments and the way it may be applied to the legal rules
(Ahkam). |
