Description
Summary:This study deals with the subject of, “marriage with al-Kitabiyyat (the woman from the people of the book) in the contemporary setting”. It is designed to address this issue in the light of opinions expressed by the classical jurists and exegetes. Additionally, it highlights the debate about the issue among the contemporary legal scholars. To accomplish this, the researcher employed two main methodologies, namely inductive and analytical. The former enabled him to collect the juristic discourse on the issue, and the latter helped in the analysis of this data, and in reaching to conclusions based on the Qur`ān, the Sunnah, and the teachings of the Saḥabah on the matter. The study concludes that the basic position of Islam on the permissibility of marrying a woman belonging to the people of the book cannot be disputed, but, given the conditions in which we are living today, the multitude of harm ensuing from such marriages far outweighs whatever utility that it may have. Accordingly, most of the contemporary c ulama' ruled that it should be prevented on the bases of the doctrine of sadd al-dhara'i', and in order to avoid corruption. Finally, the study advises Muslim youth to avoid this marriage due to the consequential harm that it entails .It also urges Muslim scholars to rigorously propound the idea of facilitating the means for marriage among the youth, and to advise them of the utmost necessity of chastity before marriage, rather than marrying a kitabiyyah.
