| Summary: | This research focuses on the study of bayan (elucidation) in the opinion of Imam al-Shafi'i and al-Jassas. Imam al-Shafi'i , the author of the book al-Risalah is the first usuli who wrote on bayan. In his book al-Fusul fi al-Usul, Imam al-Jassas expresses his disagreement on certain views of Imam al-Shafi'i about bayan. This has become a subject of dispute between the bayan of Imam al-Shafi'i and that of Imam al-Jassas The research is a usuli comparative study between bayan in these two books. Therefore, the research has followed analytical and comparative methods in finding literal and technical meanings of bayan, and its catergorisations, as well as clarifying the similarities and differences between the bayan of Imam al-Shafi'i and that of Imam al-Jassas. This research has found that bayan is a word that denotes abundance of meanings. It is used in various sciences due to its importance of meaning and indication. The concept of bayan has developed in the views of usuli scholars as well as in linguistics. As a consequence, the concept of bayan differs from one scholar to another which resulted in three main meanings; indicator (dalil), information (i'lam) and indications (dalalat). The research has discovered the reasons for the differences between the two books and opinions regarding bayan by focusing on one of the main meanings which is dalalat. Intellectual differences in dealing with these dalalat will no doubt lead to differences in deriving the rulings of the Shari'ah, which is evident in the certain juristic issues. The study is important as it highlights the summary of the disputes between two imams on bayan, which benefits both usul and fiqhi studies alike. The research has concluded that the disagreement between Imam al-Shafi'i and Imam al-Jassas on bayan should not be addressed within the same usul framework. The reason is that Imam al-Shafi'i addressed bayan as the evidence (dalil) whereas Imam al-Jassas addressed bayan as the meanings of juristic terms (dalalat). Despite the divergence of scope of study between Imam al-Shafi'i and Imam al-Jassas, the latter is deemed critical to the former with regards to certain issues pertaining to bayan such as the definition of bayan. Besides there is also a difference between the purposes of writing these two famous books. In addition, the role of semantic development has also contributed to the differing concepts of words and meanings. |
