| 520 | |u This thesis aims at studying the issue of debt selling and its impact on financial markets. The thesis also addresses the concept of debt selling and its types, features and relationship with loan according to Islamic law and based on the views of Muslim jurists. It addresses the impact of debt instruments on conventional financial markets, the very reason for the current financial crisis. The researcher applies the inductive method to trace the views of classical and contemporary scholars on the issue at hand. The analytical method is also used to investigate the concept and practices of debt selling. especially on the impact of debt instruments and contracts on conventional financial markets. The researcher employs the comparative method to compare the views of classical and contemporary scholars on debt selling in order to adopt the more dominating one. The study concludes by ascertaining that debt selling is mainly responsible for the recent financial crisis, the very reason why the Shariah prohibits such instrument. Therefore the study recommends the establishment of Islamic financial markets in all Muslim countries, with emphasis on Islamic capital market and Islamic money market; markets in which real assets are traded and in a manner which is fully Shariah compliant. | ||
