520 |a With the With the huge leap in modern technology, especially in the field of medicine, surgery has expanded from being merely for the purpose of healing to include what is known as plastic surgery, surgery which is carried out with the aim of improving the external image of the body. It is sought in order to remove distortion caused at birth or by external elements. The need for such surgery arose in order to treat the outcomes of accidents and burns that have become common due to accidents caused by airplanes, cars, trains, and various forms of sports. What distinguishes this type of surgery is that it does not usually relate to a disease; rather it is applied for improvement. Also it is carried out slowly and the patient may be fully consciousn. Due to this, Islamic scholars dispute about its permissibility and the adequate legislations that ought to be made to regulate it. Therefore, this study seeks to examine the concept of plastic surgery, its types and regulations, and the stance of the shari'ah towards it in comparison with the legislations that are applied in Iran, which is the first in the world in terms of the number of nose operations annually. To reach this conclusion, the study seeks to clarify the concept of plastic surgery, its pillars, types, and regulations while clarifying the ruling towards plastic surgery in Islamic jurisprudence and comparing that with the clauses related to plastic surgery in Iranian legislation. The shari'ah is based upon an important mantra of fiqh in clarifying the regulations, namely that “no harm should be inflicted or brought onto oneself”. The researcher relied upon the inductive approach in collecting the data, and upon the analytical approach in clarifying the statements of Islamic scholars, comparing them with Iranian legislation. The study concluded several points, the most important is that the most prominent view in the shari'ah is that plastic surgery is not permissible except when there is a rukhsah, or a mandate, which is in contrast to the majority of Shi'ah scholars who agree that plastic surgery is permissible, as well as the legislation applied in Iran. Among the recommendations mentioned by the researcher is a vast campaign to spread correct awareness regarding plastic surgery, and also curbing the gap between the academicians of Islamic jurisprudence and the medical authorities, who are namely the hospitals, clinics, and medical institutions with all their doctors, surgeons, and consultants. That, in addition to striving towards improving the laws pertaining to plastic surgery and the rulings related to it so that they may be comprehensive and regulative.
