| 總結: | The main objective of this study is to evaluating the Indonesian law of anti domestic violence article number 23/2004in light of Islamic law. The method of the research is based on the inductive study through collection of some different opinions of the classical and the contemporary scholars on the illegality of domestic violence in Islamic law, based on their in-depth study of the Islamic texts (Al Quran and Sunnah). In addition, the researcher applies the analytical method to explain the comparison between the Indonesian law of anti domestic violence article number 23/2004 and Islamic law. The study presents the historical background of the Indonesia law of anti domestic violence, the definition of domestic violence according to the Indonesian law of anti domestic violence article number 23/2004 and the Islamic law. It also evaluates the point of the convergence and the divergence between the Indonesian law and the Islamic law. Thus, the research strives to find ways to harmonize the Indonesian law with the Islamic law on the issues of domestic violence in order to avoid contradiction between them. This is because the majority population of Indonesia is Muslims and for the law of the land to contradict the belief of the majority of the country will be considered deviation. The research suggests that the government of Indonesia needs to review its law on anti domestic violence in accordance with the dictate of the Islamic law that majority of its citizens profess. |
