Description
Summary:This research studies and examines the issues and obligations of the disputed matters in Islamic Inheritance (Farāid). The methodologies used in this research were descriptive, inductive, and deductive methods. To complete this research, these issues were not only discussed theoretically but were also discussed in light of their application by examining and analyzing them with an indication of how they are practically calculated together with their judicial application in Malaysia. In addition, the statutory law relating to Farāid and the roles of various parties in the organization and their application were also discussed. It was concluded that Malaysia has not reached the level where litigation of disputed cases occur frequently in the courts. Further, it was also concluded that the application of Sharī'ah laws is limited in scope as it can only determine the amount of shares awarded to the legal heirs by issuing to the effect of the certificate of Farāid.
