Summary:The purpose of this thesis is to examine the distinguishing characteristics of the renewal of Fiqh methodology. This is done by referring to the efforts of Imam Muhammed Ibn Ali Al-Shawkani who was not only encyclopaedic in knowledge but also had extended the system of jurisprudence beyond what was entertained by Muslim scholars of his time. The study adopts an inductive and analytical method. It collects the opinions of Imam Al-Shawkani scattered throughout his works, analyses and systematizes his method of renewal. Al-Shawkani begins with three fundamental postulates, the prohibition of Taqlid (blind imitation) and a consequent call for Ijtihad, re-evaluation of the science of the Jurisprudence to ascertain its validity, and the renewal of the methodology of this discipline of Islamic Jurisprudence. From these postulates emerged three essentials: one, to establish the parameters of Jurisprudencial research; two, to re-examine and contextualise the issues of juristic research, and, three to redesign the intellectual contents of the educational system relating to Jurisprudence. Applying Shawkani's methodology to contemporary situation, this study argues that there is a need; a) to clearly conceptualize the Usu/ methodology; b) to concretise the reasons for the prescribed commandments; c) to develop new frameworks for jurisprudencial research; d) to enrich the Fiqh subjects by refining the old issues ands introducing new issues; and, e) to integrate the Ijtihad institution with legislative structures in modern political systems. The study affirms that these parameters represent the basic approaches to this highly significant subject, and, ultimately, represents a vital step in the service oflslamic Fiqh.
