Summary: | The research lays emphasis on the concept of adoption where its application varies according to time and place. The research discusses the issue of adoption, which intends on giving the adopted child the family name of the adopter, which though prevalent before Islam and still now, is categorically forbidden. The research deals with adoption, which is intended to ensure the child's welfare without changing his surname and given the adopter's name, and this is allowed and urged by Islam. From the viewpoint of legal theory, the research discusses the application of adoption in Brunei through the study of Islamic adoption law for children (2001), the definition of the law and that of adoption, together with people's views in general and in Brunei in particular, then the types of adopted children who are divided into legitimate and illegitimate, and pictures of adoption in Brunei. The research also discusses the legal conditions for adoption and the adopted, the adoption procedure at all stages from submission of the application to the end of the registration, together with the procedures and that of illegitimate child and penalty on the Islamic adoption law for children (2001) breaker. The research concludes with the findings and analyzes the rights of the adopted child in the Islamic adoption law for children (2001), lineage, inheritance, alimony, custody, and the state. To study all of the above, research approaches the field by conducting interviews with those responsible for adoption from both the Supreme Shar'ah Court, the Islamic Legal Unit and other institutions associated with the process of adoption. The research also adopts the analytical method to study the issue of legitimate aspects and applications of Islamic law on adoption for children in 2001. |
