| 520 | |a This study evaluates the customary practices of mortgage in Pattani. The main objective of the study is to describe the views of Muslim scholars regarding the current mortgage practices in Pattani as to whether the rules governing their application and usage based on customs are in line with the Shari'ah. Another objective is to find out whether the operation of the Islamic pawn-broking in the Islamic Saving Co-operative of Pattani Limited is also in line with the Shari'ah. The researcher used the inductive approach in the collection of information from jurisprudential sources as well as past and current studies in the field of mortgage. Also the study employed the descriptive method to identify the norms of the community of Pattani in the application of the mortgage. Again, the researcher approached experienced officials in mortgage management, scholars as well as beneficiaries of mortgage for information regarding mortgage procedures as practiced and as enshrined in the Shar'aah. The analytical method was employed by the researcher to analyze and evaluate what was discussed on the subject matter regarding mortgage applications in Pattani. The study found that the mortgage practices of the members of the community in Pattani since a long time ago are based on customs. However, whereas one aspect of it is in line with the Shar'iah, there is a mismatch with the teachings of Islam in the other aspect. Moreover, the study identified that the banks and institutions that provide Islamic mortgage transaction require their customers to rent on expenditure spent on keeping the mortgaged and the sponsorship. The second service mortgage transactions in which there are special expenses such as wages of workers and facilities in service, provide stores to save on mortgage as well as those bases that are not mutually exclusive with the provisions of the mortgaged. | ||
