| 总结: | The purpose of this study is to understand the change of fatwa produced by Majlis Tarjih of Muhammadiyah Association from between their first establishment in 1927 until our lifetime. In addition of that, from the latest record it is believed that the number of Muhammadiyah's registered member has been reached not less than 10 million people. The Muhammadiyah also has established thousands of mosques, schools, and hundreds of universities. Hence, the study about the change of fatwa produced by them considered as important study for it may affect the life of million's member of Muhammadiyah directly or indirectly. The board has announced 16 methods used in weighting issues including their confirmation of the probability of fatwa to be changed, it made the researcher curious for whether they can keep their own method or not in case the fatwa has been changed. This thesis contains four chapters; Chapter One is about the research plan and it's general structure, and Chapter Two is about the definition of both Muhammadiyah association and Majlis Tarjih and their method in weighting issues, and Chapter Three describes one maxim in Islamic jurisprudential maxims, “Change of judgments shall not be denied by change of times” and how it was practiced and also the relation between this maxim and the methods used by members of Majlis Tarjih to solve problems, and Chapter Four describes the change of fatwa belong to Majlis Tarjih and the discussion of mentioned cases and what caused the change. The researcher has used two methods in answering the problem; the first is analysis method, and it is used to analyze the collected fatwa from books and magazines produced by Majlis Tarjih in order to understand the methods used in both the old fatwa and the new one. After analyzing the change of fatwa, the researcher tried to approach the change of fatwa from the view of Islamic jurisprudential maxims and Islamic control fundamentalist to know whether the cause of change is suitable to Islamic principle or not. There has not been any research found to identify the cause of fatwa in Majlis Tarjih of Muhammadiyah in general, but the researcher has collected five change of fatwa produced by them, and they are; The change of fatwa of smoking, the change of fatwa considering rising place to determine the beginning of Arafah fasting, the change of fatwa in hanging the image, the change of fatwa in using sitr (cover), the change of fatwa of bank's interest. The researcher has obtained number of findings; the most important of them there are direct relation and indirect relation between Islamic jurisprudential maxim “Change of judgments shall not be denied by change of times” and the methods used by members of Majlis Tarjih. And it is confirmed that the four terms used by them in the change of fatwa are all suitable with intent of God. |
