Description
Summary:The purpose of this thesis is to introduce Shaykh Al-Albani by stating his biography, academic career and academic efforts in the aspects of both Fiqh and Usul al-Fiqh. In addition, it discusses the principles on which his jurisprudential inference is based, and his jurisprudential status through his views on Fiqh and Usul al-Fiqh. These views are presented in two aspects. The first aspect is theoretical: it discusses the fundamental jurisprudential principles of Usul al-Fiqh, with the views of Shaykh Al-Albani and his criticism of those who opposed his views. The second aspect is practical: by applying these fundamental jurisprudential principles of Usul al-Fiqh on the issues that are inferred in purification Ţaharah and prayer Şalah. In this study, the researcher has adopted three research methods. The first method is the inductive method, through which the fundamentals of Usul al-Fiqh and the jurisprudential issues are traced in Shaykh Al-Albani's books. Secondly is the analytical approach, by means of which he studied the fundamental principles of Usul al-Fiqh and the jurisprudential issues, and discussed and analyzed them. And the third is the critical approach to provide a more accurate explanation of the preponderant opinions. The researcher has obtained a number of findings, among which the most important is Shaykh agreed with the majority of scholars on the fundamentals of inference in general. He did not have an independent book on the fundamentals of Jurisprudence Fiqh, but traces of these fundamentals were discussed in several places in his books. Moreover, the practical aspect of the principles of jurisprudence was more evident than the theoretical one, bearing in mind that Shaykh occasionally turns towards the differences of Usuli scholars. Shaykh Al-Albani did not seclude himself in any jurisprudential issue and he did not have any unique opinion about them. In addition, he relied on some fundamental principles of Usul al-Fiqh in outweighing some jurisprudential issues, in which he considered inference through fundamental principles of Usul al-Fiqh as a pillar to establish the Islamic legal rulings. The response of Shaykh Al-Albani to his opponents did not depend on his refutation of their principles of inference. Rather, he sometimes resorted to forcing them to accept his opinion according to their own principles.
