Summary:Waqf or prohibition is extremely crucial in Islamic philanthropy which started started since the time of Prophet Muhammad S.A.W. Islamic scholars have worked to find legal judgement of waqf from the primary sources of Islamic Legislation related to waqf. The objective of this research is to examine the concept of borrowing and investment in waqf and their legitimacy and classical and contemporary opinions scholars about it. Since opinions about borrowing and investment from scholars are many, this research focused on two sections: the first section, scholars said that it is not permissible to borrow and investment of waqf, but the second said it is permissible with some regulations. This research describes the regulations that have been agreed between majority of scholars and have limited the problems in borrowing of waqf into two sections: permission from donors and permission from judges. The practical of borrowing of waqf is divided into two types: old methods and the modern method. The old methods are divided into three: borrowing from baitulmal or public funds, borrowing from nazhir of waqf and borrowing from another fund of waqf. The modern method of borrowing of waqf is called waqf-sukuk which is to finance the waqf projects. This paper also discusss some types of old waqf investment, for example investment through muzara'ah, masaqah, mugharasah, murabahah, istishna' and mudharabah.
