| Summary: | This research revolves around Imam Taj al-Din Abū Ḥafṣ 'Umar bin 'Ali al-Fakihani (654-734), and his work al-Tahrir wa al-Tahbir which is an explanation of the book Risalah of Ibn Abi Zayd al-Qayrawani in the Maliki fiqh. The researcher chose to study this work for several reasons. The first reason is concerning the intellectual value of the work itself as being an explanation on one of the most important adopted works in the Maliki School. The second reason pertains to the high standing of its author among Maliki jurists. The research contains two parts in addition to the research proposal: a thematic, analytical part and a documental, investigative one. The first part has been prefaced by a brief introduction on Ibn Abi Zayd al-Qayrawani including his life, his position among the scholars and the importance of his work. The researcher then moves to talk about Imam Taj al-Din and gives a brief introduction about him and his personality and position among scholars and students. He then speaks about his published academic heritage and briefly introduces each of them. The researcher also speaks about the methodology of al-Fakihani and the sources he used. The second section includes the investigated texts (after Tahqiq). The researcher investigates only three chapters in the prayer section, while following the methodologicl and technical rules of investigation (Tahqiq) established by the specialists. Thus, he makes a reasonable effort to write and produce the text correctly and without errors and distortions as much as possible and then documents the sources which Imam al-Fakihani used. The most important results the researcher has reached is the distinction of Imam al-Fakihani in his display of issues as he provided an encyclopedic explanation, he expanded in the mention of linguistic meanings and the differences between the people of the language; in addition, he expanded in the mention of disputes within the Madhhab itself, and outside of it, along with the mention of evidences and the attribution of opinions to their owners; and perhaps the high number of quoutes from his works and adoptation of his views are due to the high position he reached in his academic life in general and within the Madhhab al-Maliki in particular. |
