Description
Summary:AAOIFI issued Accounting, Auditing and Governance Standards for IFIs (AAGSIFI) while BNM issued Shari'ah Governance Framework (SGF). Both contain guidelines on duties and decision-making process for Shari'ah Committee. There are similarities and differences between them but there is no prior study examining both guidelines in the light of Shari'ah principles. This study aims to compare and analyse both guidelines in the light of Shari'ah principles. The researcher used descriptive methods and analytical methods to present the findings and suggestions while comparative method to measure the similarity and dissimilarity between both guidelines. The researcher found that AAOIFI comes out with a general explanation of the duties of Shari'ah Committee which are directing, reviewing and supervising. Meanwhile, BNM lists out eight specific duties which comprise of basic principles of advising, endorsing, supervising, assisting, consulting and reporting roles. In addition, BNM mentions the decision-making guidelines in one of the SGF's appendix while AAOIFI does not state them in its guidelines in a specific sub-topic. Nevertheless, there are still some points related to the decision-making process scattered throughout the whole document. Both duties and decision-making process guidelines in AAGSIFI and SGF are in line with the Shari'ah principles. The researcher then suggests that the duties of Shari'ah Committee should be focusing only on decision-making, supervising, endorsing and consulting roles. The Shari'ah Committee also must avoid from technical duties. Both guidelines need an explanation of decision-making guidelines for Shari'ah Committee on two sides: Shari'ah meeting management and fatwa means and methods. This study is significant because it integrates the duties and decision-making for Shari'ah Committee guidelines between BNM and AAOIFI and examines the compliance of both guidelines with Shari'ah principles.
