Summary: | The primary purpose of this research is to explain the meanings of 'Precaution' in fiqh, its concept and its practicality in the contemporary issues regarding fasting. It highlights the methodology of Muslim scholars in derivation of the contemporary issues (ahkam fiqh) and the implementation of the fatawa. The research defines the concept of 'Precaution', highlighting some selected contemporary issues in fasting and giving its preferred views based on the concept of 'Precaution'. The research applies the inductive approach by analyzing several text, books and fatawa regarding the issues and the analytical method to analyze available texts and derive out some selected opinions of Islamic scholars on the concept of 'Precaution'. The research has discovered several points which are substantial. 'Precaution' in Sharia'a Islamic Law has its own indicator that must be followed. Generally, the contemporary issues regarding fasting contain several opinions of scholars and the practice of 'Precaution' in this field is mandatory because the fatawa is based on uncertainty. Thus, a pious Muslim must avoid the uncertainty by applying 'Precaution' in his actions. This researcher hopes that this study would benefit mufti and religious scholars for them to be more precise in applying this concept in their fatawa. |
