| Summary: | This research examines the scope and potential of investing the waqf properties using different types of innovation financial transactions To carry out this study, the researcher relies upon analysing the views of shariah scholars regarding these new transactions.The transaction opted by the researcher, in which the investment of waqf properties is proposed, is BOT (Build, Operate and Transfer). The BOT system has been widely discussed by the shariah scholars, lawyers and international organizations. The consequent impact, responsibilities and duties of both parties after the application of BOT will also be delineated. Since the chance of transactional disputes, at times, cannot be overlooked, the researcher has explained the views of Islamic jurists regarding the settlement of disputes. This explanation will be preceded by juristic adaptation of dispute settlement and the role of Islamic legal ruling (qat'i) in it. The researcher has also tried to explore similarities between BOT transactions and other transactions and to classify them into suitable categories of Islamic jurisprudence. The study also explains the concept of waqf and its role in the field of Islamic economics and BOT as a modern day real estate and mothod of investment. |
