| Summary: | This study aims to highlight the customs related to marriages in the Turkish region of Anatolia, and precisely in the city of Tokat, and to assess compliance of such customs with Shari'a principles and rulings. The study also highlights the wrong customs in light of Maqasid (objectives) of Shari'a. The society got used to certain customs prior to engagement and marriage or between these functions. The society looks for protecting rights of its members and supporting them, also it encourages expression of happiness during these stages, and this is what Islam calls for. However, some members of the society commit acts, either intentionally or without intention, which are in contradiction with Shari'a rulings and its objectives, and this is identified as a research problem. The present study aims at suggesting solutions and means to modify these mistakes while using Shari'a objectives as a tool in this task. The study was carried in five chapters i.e. first on research plan and general structure, second on explaining basis of customs and marriage and their permissibility and objectives, third on customs before engagement, fourth on customs of engagement and afterwards and, fifth on customs of marriage function in light of Maqasid of Shari'a. The researcher applied inductive reasoning in following topics of the research. The content analysis was applied to find out the customs followed by the society, to analyze the field study carried during the research and to find out how to benefit from the study in analyzing and rectification. Also, the researcher applied content analysis in highlighting the customs which are in line or against Shari'a and its objectives of bringing the welfare and avoiding harm, besides suggesting ways to rectify the later one. The research concluded various results and the most important ones are that the objective of these customs is to express happiness even if the society may commit some mistakes in expressing itself, and the society in the region of Anatolia was affected by new customs which were formed of the modernization moment in Turkey and media pressure which is influenced by western culture. The research provided some suggestions and the important ones which are the wrong customs need to be rectified in accordance with the objectives of Shari'a and, particularly, with the objective of protecting the human race, expression of the happiness should be with the guidelines of Shari'a and rectification of wrong customs could be possible through collaborative efforts among the state, legislator, social institutions and preaching activities in raising the awareness and spreading the healthy cultural values. |
