| Summary: | The Islamic endowment arose and developed under the Islamic civilization, and the endowment has played its role in the spheres of life, so it can also contribute to the fields of life in different eras despite the progress of the requirements of life in terms of social, scientific, cultural and medical fields and in the field of industry and agriculture, so that it is compatible With the principles of the Sharia, its purposes, and its purpose of legislation.
The Kurdistan Region possesses a large number of properties from endowment funds, including agricultural lands, shops, residential buildings, and fruitful orchards. Nevertheless, it was not without administrative, economic, legal, and social problems in its endowments like the rest of the other countries, and this research came to find out about The origin of these problems, and their causes, following the inductive approach, to collect scientific material by referring to ancient and contemporary sources and references, then the analytical method to study the basic concepts constituting the elements of the research, by analyzing the opinions of scholars and researchers on the issue of the endowment system, with a field study represented in interviews with Endowment officials and administrators to know the administrative problems, their causes, the statistics they have, and suggestions for how to reach the right solution, as well as with specialists from scholars, law experts, and economics, from university professors; To complete the evaluation process, especially benefiting from studies and seminars on the endowment system in other countries, hoping that these problems will be solved under good governance, within the purposes of Islamic law.
The researcher have studied several conclusions, including that managing the endowment system in light of the good governance system creates people's reliance in the endowment, develops its process, and affects the increase in the investment process, as well as achieving various reconciliation, despite the organization of the endowment process from the behavior of administrators and others, in addition to its institutional protection from Corruption and mismanagement, while raising the level of transparency, in it, especially the high demand for the endowment, as well as several ways to invest the endowment money in the region. |
