| Summary: | This study is an analysis of “ Marriage with non muslim women according to Islamic laws and laws in Indonesia”. Marriage with non-muslim women is common in Indonesia, as the number of people in Indonesia is composed of various ethnic groups and religions. In Indonesia, there are several laws that regulate and explain marriage law with non muslim women, but the explanation is deemed unclear and there is a difference of opinion among the ulama that raises the perception that there has been a vacuum in marriage law with non muslim women. This study is literature or library research with collecting data from works of scholars relevant to the study, which is then analyzed and interpreted by the author. This study focused on the concept of marriage law with non muslim women, the causes of marriage and the consequence of marriage with non muslim women. The results of this study are (1) Islamic law and laws in Indonesia declare prohibiting marriage with non muslim women, (2) The cause of marriage with non muslim women is due to misunderstanding between different pairs of aqidah, (3) The effects of marriage with non muslim women are related to guardianship, testimony and education of children, distribution of wealth or inheritance. |
