Summary: | This study aims to show the legal and legislative transactions in terms of the Somalia modern financial transfers and its agreement with the rules of the Islamic laws and the applied law in the Somalia through the two actions namely receiving and sending within all the actions that these organizations deal with Somalia and other customers. This study also deals with the electronic technology development of the internet that through it the transfer is conducted easily and quickly within the Somalia organizations. Regarding to the structure of study, it starts with the first chapter which deals with the general framework of the study while chapter two addresses the concept of the Somalia modern money transfer. Chapter three shows the ways that these transactions of Somalia money transfers carried out through the internet. While chapter four deals with the Shari'ah controlsfor the wages that these organizations take for its transfer services and its responsibility for doing that. To be more specific this study deals with the vague aspects of these transactions and attempt to frame them within the Islamic and legal rules in order to control them with the Islamic rules as a way to keep money and instill the confidence for those who work in the money transfers. In order to crystalize and solve the problem, the study come up with the positive aspect which is considered as a new addition for the research through the descriptive approach of the reality of the Somalia transfers. This study uses also the comparative and analytical approaches in order to reach to whole conceptualization that gives an advantage to the dealers of these transfers as well as to develop its performance and effectiveness in a way that move from secret to public. |
