| 总结: | This study aims to investigate the legislation and laws for the regulation of the Sharia in the Libyan Islamic banks. Therefore, determine the suitability of such laws to the Islamic banking activity, and we need to reform the insufficiency regarding to legislation with the laws Islamic banks in the leading countries of the same field. This study also examined the required tools for the development and rehabilitation of workers in the field of Sharia Islamic institutions, and to identify institutions that supervise the forensic audit, this study was based on the descriptive to describe the reality of Sharia law in the Libyan banks. The analytical method and comparative analysis of the Libyan Islamic banking laws and comparing the legislation with leader countries in the field of Islamic banking to investigate jurisprudence ancient and contemporary legitimacy to make sure that meet the laws of Sharia Islamic. The study concluded that the legislation regulating the work of Islamic banks in Libya does not constitute an obstacle to the establishment of Islamic banking institutions which conform with Sharia in their transactions, particularly once enhance those laws some complementary regulations by the Central Bank of Libya and Sharia Supervisory Board, and the development of the legal framework which is conforms with the Islamic banks. |
