| Summary: | The study aimed to discuss the penal procedures in reducing customs crime in the United Arab Emirates. The problem of the study lies in the lack of clarity of the Unified Customs Law as a result of the recent implementation of the Unified Customs Law among the Gulf countries for the year (2022), as many of the legal texts related to the Unified Customs Law Needs explanation, which may cause further gaps in the Uniform Customs Code; Which may cause customs crime to occur in the United Arab Emirates. The importance of the study is highlighted in shedding light on clarifying the penal procedures to reduce customs crime in the United Arab Emirates, through clarifying and interpreting the unified customs law in the United Arab Emirates. The study followed the descriptive analytical approach to describe and analyze the criminal procedures to reduce customs crime, as well as analyze the unified customs law applied among the Gulf countries. The study also followed the qualitative approach in identifying the factors, causes, motives, and internal and external variables that drive the reduction of customs crime in the United Arab Emirates, while the qualitative approach was used to clarify the penal procedures in the United Arab Emirates. The study also touched on some judicial rulings for many customs crimes that occurred in the United Arab Emirates. The study reached many results, including: The judicial police officer has many powers that he enjoys in order to reduce customs crime in the United Arab Emirates. The results also showed that there are many agencies that participate directly to assist the judicial police officer in taking criminal procedures. The study recommended the necessity of working to significantly reformulate the unified customs law in order to clarify customs crime and the appropriate punishment for it. Special standards must also be set to reduce customs crime among the Gulf countries. The study clearly revealed the followed procedures imposed by the unified customs law applied among the Gulf countries. |
