legitimate judge. The study aims to analyse the legal origin of The Personal Affairs
Department, according the Holy Quran amd the Sunnah the legal rooting for the
prosecutors to the laws that currently used in the West Bank, and the proposed draft laws
for ratification. The study also aims to determine which judicial body that The Personal
Affairs Department should be followed. The researcher adopted the inductive method and
analytical approach. The importance of research is in the representation of the Personal
Affairs Department to the public rights legitimacy, whether to God or the rights of
individuals, and conservation and recovery in the case of abuse and violation of any of
them. The researcher has succesfully demonstrates the legal origin for the Personal
Affairs Department, Personal Affairs Department regarding the Palestinian laws in the
Islamic courts, and the proposed draft related. The researcher also finds that the Personal
Affairs Department within and follow the Office of the religious judiciary departments.
