Summary: | The thesis explores consumer protection in respect of the electronic commerce transaction in Malaysia. The increasing number of people choosing to shop via online medium nowadays results in the crucial need for better and comprehensive legal protection. This thesis will identify e-commerce and Electronic commerce--Law and legislation--Singapore. infringements in the area of intention to create legal relation, legal capacity, description and delivery of goods, and international jurisdiction. The thesis critically examines the legal approaches and legal protection in Malaysia to find out if they are sufficient or not. This research is carried out through the doctrinal research method by using library-based data collection. Besides that, this research examines the practices adopted by other developed countries, which are the United Kingdom and Singapore, for Malaysia to learn lessons which could be implemented in order to offer more effective protection on e-commerce transaction. Apart from that, this research scrutinises the concept of electronic contract in Islamic views in relation to form of contract, contracting parties and subject matter to ensure the validity of contract as well as the dispute resolution from Islamic perspective. The significant findings of this research are an improvement in relation to legal requirement in enforcing the laws and regulations that are important when dealing with e-commerce transaction. Amended and additional provision of the statutes of e-commerce laws and regulations are suggested in this research in order to create an effective legal implementation of e-commerce transaction in Malaysia. The thesis concludes by providing recommendations on the implementation of compliance measures that will effectively contribute towards improving e-commerce and online consumer protection in Malaysia. Therefore, improving legal requirements and amendments is prioritised as high e-commerce transaction nowadays require better consumer protection and it assists in the developmental growth of the e-commerce transaction globally. |
