| Summary: | This study discussed an academic discourse on crimes committed via the electronic medium, and the legal treatments for this type of crime. The study aimed to clarify the forms and images of insults, purity and swindling through the electronic medium in Islamic law through the presentation of jurisprudence assessments, as well as the study aimed to clarify the legal treatment for it in the United Arab Emirates (UAE) law, and to clarify the legal effects of those crimes committed through the electronic medium. The study also aimed to clarify the impact of crimes and its reputation in United Arab Emirates law, also examined and analyzed the concept of electronic crime of blackmail and the motives behind the commission of that crime, and the legal implications of that crime. To this end, the researchers adopted the descriptive analytical method, to describe the phenomenon and analyze it in all dimensions and aspects, the study concluded with a number of results, the most important of which was the importance of differentiating between the general criminal policy mentioned in the Penal Code and the different criminal policy that these crimes need, whether they take place or as punishment. The Emirati legislator saw this difference in the criminal model of these crimes, their means, their perpetrator, and their entire self from their traditional counterparts, although they were similar in purpose and desired. From the study, it became clear to us that awareness and individual awareness by the users of electronic circles in their dealings with those and their lack of keenness in the circulation of their information or in adequate protection. In addition to the weak legal awareness of a user of the Internet about criminalization and punishment, which intensifies in many cases without looking for intentions. |
