Summary:There has been a growing demand and interest of E-commerce by the consumers all over the world, and Malaysia is no exception. This study aims to provide an appropriate guideline of online trading according to Islamic business principles. The specific objectives of this study are to analyse the concept of E-commerce from the shariah perspective, to identify the type of misconducts committed by online business sellers while doing online transaction and also to suggest a guideline for online business activity according the shariah principles. This study employed a qualitative research method that include library research, document analysis and observation of the 10 online portals that were selected based on the highest search rating by the consumers. The elements observed in the portals were the aspects of compliance and misconduct based on the Consumer Protection Act 1999. From the analysis, it can be concluded that the concept of shariah – based E-commerce follows the characteristics of Islamic business transaction. The concept also comprises the process of offer and acceptance as suggested in Islamic contract, avoids interest in the method of payment, promotes products transparently and ethically and applies the Islamic ethical values. It is also discovered that there have been serious misconducts practised by the online traders including not displaying business details, not providing business terms and conditions, utilising non-Islamic financial institutions for the method of payment, unclear notification on the type of courier services being used and using non-Islamic approach in promoting products. This study suggests a set of ethical guidelines according to the shariah principles to the online traders in Malaysia. This study is very useful to the online traders, government, statutory bodies and consumers.
