| 总结: | Al-Naskh or abrogation is one of many famous Qur' anic problems. Muslim scholars are not of the same view on this matter whether it has really occurred or not, after they have unanimously agreed on its occurrence in some of Prophetic sayings (al-lfadith). However, the writer of this dissertation tends to the opinion of the 'U/amii'who held that al-naskh has really happened. Although al-nas/ch has very broad areas to be studied. the writer concentrates only on some of them such as its types and kinds., its application to the texts or the rules in the Holy Qur'an or to both of them, the number of abrogated Qur'anic ayat, the rationale behind al-naskh. These studies came after the discussion on its literal and technical meaning and on the debates among the Muslim scholars pertaining to its occurrence. In addition. this research, which is based on the library-study, also presents some discussions on amendment of laws for comparison to al-naskh such as the meaning of amendment, the meaning of constitution ( dustiir ), the origin of the word "constitution", the history of the first utilization of the word "constitution", the types of amendment, the types of constitution. the ways of repealing constitution and the rationale behind amendment. Lastly, in the third chapter, this research-which consists of three chapterspresents the discussion on the similarities and the differences between a/-naskh and amendment of laws besides the discussion on one of the objective of a/-naskh and amendment of laws. |
